Accident Lawyers, Personal Injury

Pedestrians always face risks when venturing out amongst moving traffic.  Obviously, those traveling on foot are completely exposed to harm when vehicles collide with them, and the majority of Miami pedestrian accidents lead to at least one injury.  Such appears to be the case with a Miami hit-and-run crash that occurred this morning when a man was crossing a local street and was struck by a vehicle.  The vehicle fled the scene after the accident.

Unfortunately, this situation is quite common.  Statistics show that there are more than 8,000 pedestrian accidents in Florida on an annual basis that result in nearly as many injuries.  More than 500 people are killed in Florida pedestrian accidents every year, and what’s most troubling is that the numbers appear to be climbing at a slow but steady rate when compared to previous years.

Leaving the scene of an accident is also a serious crime, and if or when the driver is ultimately apprehended he or she could face significant criminal liability.  According to the Florida statutes:

316.027 Crash involving death or personal injuries.–

(1)(a) The driver of any vehicle involved in a crash resulting in injury of any person must immediately stop the vehicle at the scene of the crash, or as close thereto as possible, and must remain at the scene of the crash until he or she has fulfilled the requirements of s. 316.062. Any person who willfully violates this paragraph is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.”

If a defendant is convicted of a felony of the third degree, he or she could face up to five years in prison and a fine of up to $5,000.00.  Of course, this form of liability would be exclusive of any civil liability the driver could face if the pedestrian who was injured seeks the help of a Florida personal injury lawyer.

If you or someone you love has been harmed by a negligent driver, you too should seek the help of an experienced Florida auto accidents lawyer who understands how to hold those responsible for harm accountable.  Contact Bernstein & Maryanoff today to schedule a free initial consultation.
