Personal Injury, Wrongful Death

Construction work is not only extremely taxing in the physical sense, but it can also be quite dangerous.  This line of work is always one that’s near the top of the national list for worker deaths every year, and there are many reasons for this reality.  When an employer is not taking every precaution necessary, it only adds to the risks every worker takes on when he or she starts the day.  Tragically, one man paid with his life in a recent accident, and OSHA has fined the company for safety violations.

According to the Sun-Sentinel:

“A Pompano Beach construction company has been fined $18,375 in penalties for safety violations in the death of a 43-year-old worker who was pinned under a fallen crane.

Albert “Tiger” Phillips, a father of three who lived in Coconut Creek, was helping shore up a seawall June 16 in Lighthouse Point when a crane fell and pinned his legs. He was taken to North Broward Medical Center, where he was pronounced dead.

The U.S. Occupational Safety and Health Administration found Ray Qualmann Marine Construction Inc. allowed an operator who had not received training for the Link-Belt LS-58 crane to use it. The company also did not conduct an annual inspection that would have noted issues with the crane, such as rusting of a boom, a missing boom angle indicator and poorly welded lacings, according to an OSHA report.”

The man’s family is currently receiving worker’s compensation benefits and the company has paid for funeral expenses and other costs.  However, the worker leaves three children behind and there could be civil liability to pursue.  If you or someone you love has been injured or worse in a workplace accident, you need the help of Fort Lauderdale personal injury lawyers who understand the intricacies involved with these situations.  Contact Bernstein & Maryanoff today to schedule a free initial consultation.
